These Terms of Service (the "Terms") govern your use of truebuddyai.com and the TrueBuddyAI voice companion service (the "Service"), provided by Sagentica ("we", "us"). By creating an account or using the Service, you agree to these Terms. Please read the limitations in Section 3 carefully.

Important. TrueBuddyAI is a companion service. It is not medical advice, not a medical device, and not a replacement for emergency services (911) or professional care. Do not rely on TrueBuddyAI as the only safety system or medical resource for yourself or a loved one.

1. The Service

TrueBuddyAI provides a voice-first AI companion designed for older adults — conversation, daily check-ins, medication and routine reminders, a family bridge for staying in touch, wellness summaries for family and care teams, and an emergency-assistance feature. Features vary by subscription plan.

Not healthcare. TrueBuddyAI is not a healthcare provider and does not provide medical advice, diagnosis, or treatment. Wellness summaries are informational only and are not clinical assessments.

Reminders are aids, not guarantees. Medication and routine reminders are convenience features. They do not guarantee that any medication is taken or any action is completed.

The emergency feature is best-effort. Emergency assistance depends on electrical power, internet connectivity, working hardware, and third-party telephone and network services. It can fail or be delayed. It is not a certified medical-alert system and must not be relied upon as the sole means of obtaining help. Always maintain independent emergency arrangements.

You may provide notes, reminder details, voice samples, and contact information. You grant us the limited license needed to operate the Service for you. You confirm you have the right to provide any personal information about other people (such as family or emergency contacts).

7. Privacy

Our handling of personal information is described in the Privacy Policy. For HIPAA-covered deployments, see the Business Associate Agreement.

8. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability.

9. Limitation of liability

To the maximum extent permitted by applicable law, Sagentica's total liability arising out of or relating to the Service is limited to the amount you paid for the Service in the 12 months before the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including those relating to health, injury, or emergency outcomes.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by our negligence, or for fraud.

10. Indemnification

You agree to indemnify and hold Sagentica harmless from claims arising out of your misuse of the Service or your breach of these Terms, to the extent permitted by law.

11. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms, non-payment, or where required by law. On termination, the data provisions of the Privacy Policy apply.

12. Changes to these Terms

We may update these Terms. For material changes we will provide reasonable notice and update the "Last updated" date. Continued use after changes take effect means you accept the updated Terms.

13. Governing law and disputes

These Terms are governed by the laws applicable at Sagentica's principal place of business, without regard to conflict-of-laws rules, except where mandatory consumer-protection law in your jurisdiction provides otherwise. The parties will attempt to resolve disputes informally before pursuing formal proceedings.
